An open letter from our President, Christopher Coggan, on the legal status of Therapy Pure Essentials’ products.

First and foremost, thank you for taking the time to visit Therapy Pure Essentials and I encourage you to check out our education section regarding the potential benefits associated with our unique and growing product line up.

Whether you are a returning customer or a new customer, a current user of Cannabidiol (CBD) infused products, or someone searching for a naturopathic alternative to institutionalized pharmaceutical remedies, I am happy to guide you, via google, to the hundreds of online resources available. The power and efficacy of CBD for a wide ranging number of mental and physical health-related problems has been researched by many respected institutions across the globe, from the many studies published in peer-reviewed journals, to studies reference by our own U.S. National Institute of Health. I encourage everyone to do their due diligence, and speak openly and candidly with a health care professional about the use and dosage of any CBD products.

As the year draws to an end and we prepare for a new administration to take control of the federal government, many interesting changes will no doubt come about over the next four years. Although there are no guarantees about future regulations of the Hemp industry, current trends suggest explosive growth through 2020 and beyond. Since the passage of Sec. 7606 of the 2014 Farm Bill, hemp is being grown in 32 states and the sale of hemp-related products grows every month.

In addition, The FDA originally labelled Cannabidiol (CBD) derived from Industrial Hemp as a Dietary Supplement. In May 2015, the FDA tried to retract that position, based on the notion that it was “authorized for investigation as a new drug for which substantial clinical investigations have been instituted,” prior to it being sold as a supplement. Those supposed investigations were begun somewhere between 2006 and 2008 by GW Pharmaceuticals. The position of the hemp industry leaders, however, does not support this claim.

CannaVest,  has echoed the sentiment of the entire industry. “It is our opinion, which is broadly shared by the marketplace, that CBD has been marketed as a dietary supplement prior to commencement and public notice of any substantial clinical investigations instituted on CBD,” says Stuart Tomc, vice president of human nutrition, CannaVest. Although TPE does in no way share CannaVest’s philosophies or motivations, we do believe this fact to be true.  As a result, we have spent countless hours creating superior products in this sector.

More recently, the DEA, in a final ruling has attempted to establish a new drug code for “marijuana extract”, a link to the new ruling can be found here. After reading various legal opinions regarding this ruling, it seems clear to us here at TPE that they have overstepped their authority and their claims are baseless. The most important and undeniable fact behind this opinion is not steeped in legalese or thousand-page statutes. It is simple and qualified:  The DEA is an enforcement agency, and cannot change the law or status of anything.

Eric Steenstra, Executive Director of the Hemp Industries Association, supports this notion.“It’s important to understand that this Final Rule does not change the legal status of hemp derived CBD.” They further went on to say “Cannabidiol is not listed on the federal schedule of controlled substances, and the DEA has no authority whatsoever to impede the production, processing or sale of hemp products, including CBD products, grown under the Farm Bill. We urge consumers and businesses not to panic, and continue supporting the growth of the hemp industry in the U.S.”

In addition to this, our product is unique in that it is NOT and extracted hemp oil, but rather a fractionated coconut oil (MCT) infused with pure CBD isolate. The purpose behind this formulation is two-fold. Firstly and most importantly, our goal was to address all potential legal issues by avoiding any precursor that might contain measurable amounts of any other cannabinoids (of which there are 85). As we use only the finest CBD isolate, we have accommodated that goal, as our Certificates of Analysis confirm. Secondly, we recognized that hemp extract was not the most effective means of delivery of CBDs, nor the best tasting, so we decided on a much more effective means of delivery, that being MCT oil.

The result is a product line up unlike any other in the marketplace. We will continue to push forward and provide the finest quality Cannabidiol infused products.
